A "shock ruling" in a patent dispute between Microsoft and Motorola involving the H.264 video codec means the company will no longer be allowed to distribute its Xbox 360 console to retailers in Germany and might even have to recall systems currently in stock and destroy them. The injunction against the distribution of "key Microsoft products" in the country also encompasses Windows 7 discs and the digital distribution of Internet Explorer and Windows Media Player.
"We are pleased that the Mannheim Court found that Microsoft products infringe Motorola Mobility's intellectual property," Motorola Mobility said in a statement.
Some kind of settlement is almost certain but will likely take serious negotiations to reach, as Microsoft estimates that it will cost $4 billion per year to meet all of Motorola's demands. In the meantime, the ruling won't actually take effect until Microsoft has exhausted the appeals process.
"This is one step in a long process, and we are confident that Motorola will eventually be held to its promise to make its standard essential patents available on fair and reasonable terms for the benefit of consumers who enjoy video on the web," a Microsoft rep said.
Microsoft also recently suffered a courtroom loss to Motorola in the U.S., where a judge ruled that it was guilty of infringing upon four of Motorola's patents.

1) XBOX sucks. Germany will be better without them.
2) $4 billion a year, sadly, isnt that much to a company like Microsoft.
3) Interesting article.

but yeah, this kind of infringement stuff happens constantly, I'm sure it's already fixed out.

this has gotten way out of hand... I love how people are still complaining about how microsoft forced people to use internet explorer like 10 years ago. But are totally letting companies like Google and Facebook data mine the hell out of their personal information and sell it to people. You know, that stuff microsoft never did. Lulz

$4B on a yearly basis is a massive detriment to even the largest entity.

I'm just saying, I think it's funny how people make it seem like Micro was infringing on peoples rights, which it didn't do when companies that ACTUALLY ARE infringing on rights don't even get batted an eye at.

Apparently Motorola is owned by Google currently. I hope Microsoft don't lose their appeals. I know it won't stop Germans from buying 360's from other EU countries, but it's such a petty ruling.

Microsoft still holds a near monopoly on the pc industry.
most don't know how to use linux.
Mac is worthless.
Microsoft infringes upon other people's rights on a consistent basis, just as people "infringe" upon theirs, all companies do, which is what I was really referring to, not whatever garbage you're spewing.

what I find funnier is that according to what I read here, google owns Motorola, therefore owns h.264, and yet youtube still uses flash.
(might be different things, not sure on encoding stuff as I have barely grazed it, but flash sucks).
By volkom 2012-05-02 14:15:48
its a video compression codec~ *shrug*
info here
H.264/MPEG-4 Part 10 or AVC (Advanced Video Coding) is a standard for video compression, and is currently one of the most commonly used formats for the recording, compression, and distribution of high definition video. The final drafting work on the first version of the standard was completed in May 2003.
H.264/MPEG-4 AVC is a block-oriented motion-compensation-based codec standard developed by the ITU-T Video Coding Experts Group (VCEG) together with the International Organization for Standardization (ISO)/International Electrotechnical Commission (IEC) joint working group, the Moving Picture Experts Group (MPEG). The product of this partnership effort is known as the Joint Video Team (JVT). The ITU-T H.264 standard and the ISO/IEC MPEG-4 AVC standard (formally, ISO/IEC 14496-10 – MPEG-4 Part 10, Advanced Video Coding) are jointly maintained so that they have identical technical content.
H.264 is perhaps best known as being one of the codec standards for Blu-ray Discs; all Blu-ray Disc players must be able to decode H.264. It is also widely used by streaming internet sources, such as videos from Vimeo, YouTube, and the iTunes Store, web software such as the Adobe Flash Player and Microsoft Silverlight, and also various HDTV broadcasts over terrestrial (ATSC, SBTVD, DVB-T or DVB-T2), cable (DVB-C) and satellite (DVB-S and DVB-S2).
By volkom 2012-05-02 14:18:34
my guess is that they didn't include the video codec in the specs or something. and didn't pay the royalty fee's so that's why its coming up?
By Jetackuu 2012-05-02 14:19:19
oh then strike my previous statement, short of that flash sucks, I'll stick with that.
I do know I encode h.264 in .mkv when I rip DVD's (yes I know it's illegal, I don't care).

well the last I checked the 360 requires an update to decode h.264, even windows 7 doesn't like it without updates. (hence why I first started using VLC)
By volkom 2012-05-02 14:22:21
eh flash is okay~ can make some cool things with it. but what I don't get is, why did the courts have to go extreme overboard with this and ban xbox's 360's entirely? you know they're going to come out with the next gen of them anyways later so are they going to ban that too? imo~ microsoft shouldn't sell xbox-anything to them anymore and disable any xboxlive account thats associated with any location in germany

I mean it has it's uses (and Apple were fools not to support it at all) but there's better options.
