I skimmed through the videos hoping he'd at least provide an entertaining conspiracy theory..nope. Just random rambling about elements you find in pretty much every JRPG (FF8 is actually pretty subtle about its take on God/organized religion).

Technically if they can show the street was not repaved within such and such amounts of time it can be negligence :< Its the cities obligation to fix streets and sidewalks so these things dont happen :<

The question isn't whether or not you could hold the city liable and sue. The question is whether or not it's ethical to extort millions of dollars in tax money over a minor injury by lying about and/or exaggerating "permanent physical pain". There's a difference between being a legitimate victim and being a con artist.

Theres a difference between assuming and knowing for a fact with evidence. What you make in the latter part of your statement is an assumption.

Not even to mention the article is definitely from a biased writer (Aggressive language, references to ones own projected idea of Al Sharpton, use of derivative quoting to characterize the quoted statement). If it wasnt Al Sharptons daughter, im sure it wouldnt get an article written about it (Or maybe its the fact that its Al Sharptons daughter and its a huge sum of money, which will prolly be settled out of court for a lesser sum anyway as all claims of negligence may against a city).

Let's see, claiming permanent pain after only two months, climbing ladders and wearing high heels with the supposed ankle injury, and suing for enough money to support your average person for life (and then some) when her father is famously known for being sue-happy. Yeah, I see lots of reasons to defend her.

Doesnt mean the city itself cannot be found guilty of negligence and the damages found null due to aggravation of injury. There is a case, just not a case worthy of a 5 million dollar settlement.

If it werent Al Sharptons daughter, it wouldnt be relevant either way, nor have any reason to show up here.

Also, specific injuries can be kept from further injury with medical techniques, claiming that she isnt allowed to air her grievances because she wears high heels with an ankle injury is just arguing for the sake of arguing and making a point where there isnt one.

Uhh, that could be said about anything that a politician does or says that we discuss in here. A sleazebag's daughter suing for millions over practically nothing is pertinent, because it means we could be seeing Al Sharpton 2.0 here. I'd like to ask a personal injury lawyer if those types of things are taken into account when a judge makes his or her decision. I bet you that the wearing of high heels would absolutely be usable as evidence against her case, especially when high heels can increase your risk for ankle sprain. Gee, you'd think that would be a problem for a recent ankle sprain victim.

If there were probable cause then, yes. Its a standard legal occurrence, pretty sure you could find anyone thats made a suit about slipping on uneven payment.

lol no it's not...
So you dont pay for flat surfaces in your city so things dont happen that could injure you among other multitudes of possibilities? I mean, i certainly like to not have to mountain climb to walk down the street or potentially lose my car to a pothole (Which in some ways beyond personal control, can harm others). Argument is pointless anyway, she has the right to air grievances in this country and the courts have the right to prove them relevant or not. No matter who her father is and his perceived character.

The judge needs to throw it out of court, as she's wasting the courts time and taxpayer money.

No, I pay for streets to drive on, and sidewalks to keep people out of the streets, at no point are either guaranteed to not have holes in them, or other defects, it's why I watch where I walk, and where I drive.

But as logic is going to escape this argument, wait until either the judge throws it out or the case is heard, as this is fruitless.

a business with a machine that has a faulty thermometer that was known to be faulty, but never fixed which resulted in an elderly woman receiving third degree burns (melting her skin off) across her legs and crotch, is not at all the same as normal wear and tear on a road.

But at what point does it become "normal wear and tear" and The city knows about it but opts to fix other streets instead? Or leaves certain streets damaged for longer than they are needed to.

It'd still be negligence if the problem existed, it being known about, and then someone gets hurt because the city itself decided that it would forgo repairs.

We explained the mcdonalds coffee thing. Still, if you could admit it wouldnt even be a thing if it wasnt Al Sharptons daughter then the whole "Negligence because street wasnt maintained properly" angle could easily be moot in a court too since she is asking for an absurd amount of money in damages which would be lowered to what a judge would find reasonable IF she won the case.

Incidentally, theres precedent for "Common Sense type injury" suits that could very well be called up. And then, if she made the injury worse the case would be looked at in that respect, its a normal thing personal injury cases deal with every day. She probably wont win, and then she may be charged with some form of a misdemeanor or a felony (perjury) in the process. So it REALLY doesnt matter lol.
