Does he deserve his sentence?
Just plead "Insanity". He'll do what... a year maybe... then just given psychiatric treatment and be off the hook

In reality very few people can 'get away with' pleading insanity. They're more rigorous than you presumably think when trying to validate that claim. As someone who lives in florida and have seen and known a lot of people to go through our -awesome- /sarcasm judicial system, I can say that within 3 years he'll be fully appealed to that sentence, in 5 years he'll be on parole with good behavior. If he screws up while on parole they'll book him for 10 years and he'll be out in 4.
I agree that the initial sentence is absurd and the judge in question may even be investigated for doing that. Skimming the article he should have been sentenced 15 years, out in 5 if behaves well. People just got more ammo to poke fun at my state. ; ;
Only in america.
Max you can get here is 21 years. :P With the exception of that Breivik dude ofc, probably lifetime. He committed 7 crimes so hes hardly a "first time offender"
Sylph.Kimble said: » He committed 7 crimes so hes hardly a "first time offender" while committed in a spree, with the same people, and his level of involvement is questionable at best (from the information given to us) so yes, first time. Its mulitple crimes.
That's like saying if someone goes on a murdering spree, it only counts as one murder. Sylph.Kimble said: » Its mulitple crimes. That's like saying if someone goes on a murdering spree, it only counts as one murder. Yes it is multiple crimes, and no it's not like saying that. You're mixing two separate things, nobody is saying that he didn't commit multiple offenses, but they were all done basically at the same time, it still classifies as "first time offender." You'd think statute of limitations would kick in for something like this.
Artemicion said: » You'd think statute of limitations would kick in for something like this. one would think. I simply just don't agree its a first time offense. Just because you didn't get caught the first time, doesn't mean its all one offense.

Sylph.Kimble said: » I simply just don't agree its a first time offense. Just because you didn't get caught the first time, doesn't mean its all one offense. "First time offender" simply refers to having no prior convictions. Another one bites the dust. He got more time than than billionaire R.Allen Stanford (110 years)
http://www.forbes.com/sites/walterpavlo/2012/06/14/allen-stanford-sentenced-to-110-years-in-prison/ and Bernie Madoff (150 years) http://www.nytimes.com/2009/06/30/business/30madoff.html?pagewanted=all Amusing really. The minimun time served from what I can find is just under 3 years in florida. The minimum should have been a little shy of 21 years. The max would have been 210 years. 30 years at 7 robberies.
That being said I hate these cases. They knew some people were involved but they couldn't prove who was doing the shotting. They offered a plea deal to the others and not him. IF they do pleas, they should have to offer to all to see who tries to roll over. Not just for the one person they want. I think people are willing to plea (even lie) for lighter sentances. What bugs me is he got the maximum conviction sentence from testimony of the robbers that were caught. How exactly is this a credible source to warrant maximum sentencing? There is a way..

Because everyone totally knew it existed . You know what really irks me about this sentencing?
When someone is sentenced to prison, it's not only supposed to teach the accused a lesson, it's also supposed to act as a warning to anyone else who was thinking about committing that crime. Not only is this not going to teach this man a lesson (he's never going to get out, and being a good inmate isn't going to lessen his sentence so he might as well try to escape), but this is also going to make similar criminals even worse. If they're going to do something like this, they might as well go all-out and do as much bad as possible, because if they get caught it's not like doing any worse is going to get them a worse sentence anyway. Do any of the North American justice systems have any idea what the point of jail is? Ragnarok.Jessikah said: » Do any of the North American justice systems have any idea what the point of jail is? Cerberus.Kvazz said: » Only in america. Max you can get here is 21 years. :P With the exception of that Breivik dude ofc, probably lifetime. Quote: Life imprisonment in Sweden (livstids fängelse in Swedish) is a sentence of indeterminate length. Swedish law states that the most severe punishment is "prison for ten years or life", and so life imprisonment is, in practice, never shorter than ten years. However, a prisoner may apply to the government for clemency, in practice having their life sentence commuted to a set number of years, which then follows standard Swedish parole regulations. Clemency can also be granted on humanitarian grounds; however, the number of granted clemencies per year has been low since 1991, usually no more than one or two. Until 1991 few served more than 15 years, but since then the time spent in prison has increased and in 2007 the usual time was at least 21 years. Offenders under the age of 21 when the crime was committed can not be sentenced to life imprisonment. I agree that the guy should be in jail but personally I think maybe 10 years is enough time considering it was his first offense and he didn't hurt anyone. Also our cells are pretty nice for a prison >_>
