I've never had problems creating a character on a legacy server on a weekday at around 5~6am EST. I've had characters on Excalibur, Sargatanas, and Balmung.

I tried for all hours of the day for almost a week since I promised a friend I'd join them on a legacy, never did let me.
Granted this was a year ago and I haven't tried since.

They actually give you a news post to check about creation restrictions, without having to go all the way into the game client:

It's updated routinely, so maybe that will make it easier? The crowded servers are always going to be crowded, though.
