My niece and her boyfriend stashed money back for months to pay to get into a house and out of their apartments. A month ago, they found their house, after paying the deposit of $400 and cleaning on it, they ended up finding bed bugs, the land lord has had the house sprayed 3 times over the last month and the bugs are still there, thus they have yet to move so much as a pair of socks into the house. As of today, they've moved their stuff into storage and their apartment door was locked, they are now staying with us. Now my niece is trying to find another place but the landlord refuses to return the $400 deposit despite the house having bed bugs from a previous tenant and the landlord not properly handling the situation. Anyone know if the law would be on my niece's side?

You must also inform the landlord of the condition in writing and give the landlord a reasonable opportunity to remedy it. If the landlord takes reasonable and diligent steps to address the problem, you cannot break your lease even if the problem persists. If the landlord does not respond, and you have a written lease, then you can follow the instructions for default or violation procedures to terminate the lease, or contact an attorney or local tenants' rights group for assistance. You may also have some remedy with your local health department or building department. No tenant should have to force a landlord to address a bed bug problem in a multi-tenant building. Most landlords understand that once an infestation is discovered in one unit it can quickly spread to others, and landlords are usually self-motivated to protect their own rental property from harm or damage. Think it would depend on if she filled out any paperwork and if that paperwork had the place being free of pests as part of it. If not then probably no and it would be her fault for not checking the place properly. Not trying to be a *** with that either. Courts are sticklers when it comes to contracts.
But there are examples of the law having an effect on this. What state is she doing this in? I was looking at the Wakfu screenshot on main page..what are we suppose to look at? It's just a random mine..?

Small claims court with lots of paper work to back you up could get the deposit back.

Had to schedule my test... literally every testing day through March is on a *** A shift (the shift I work) except for tomorrow. So I get to drive to north Dallas tomorrow during the height of traffic to go take a test I haven't studied for in 4 years. Yup, this is gonna end well. Donated $15 to the local food kitchen tonight at my grocery store. Sad thing is the cashier had to call a manager to ring it up because so few people have donated that they didn't even know how to work it.
Crazy when you sit down and look at how passing on your morning mocha latte for a week can be enough to give a family that is hard up enough to eat for a few days.
